  • Job Purpose/ Role

    ##Proactively investigate, negotiate, and resolve medium to high exposure E&O (Architects & Engineers Liability, Single Project Professional Indemnity, Construction Professional Indemnity, Miscellaneous E&O) claims, involving complex issues and/or litigation. Responsible for in-house claims adjusting~crlf~##Ensure claims handled within authority limits and in line with AGCS Claims Standards procedures and guidelines~crlf~##Drive third party service providers to achieve economical results and to provide a high quality service to all internal and external customers~crlf~##Technical referral point for underwriters and internal business partners. Develop and maintain strong relationships with brokers and clients~crlf~##Effective working within the global matrix

  • Key Responsibilities

    Claims Processing and Administration~crlf~##Input and maintain accurate claims records for designated accounts, within appropriate AGC&S Claims administration systems and in line with AGCS North America Claims Handling Guidelines~crlf~##Timely reporting to internal business partners on claims with significant potential and or issues~crlf~Investigation and Reserving of Claims~crlf~##Investigate high exposure domestic and international claims that involve complex issues and/or litigation - requires legal analysis~crlf~##Evaluate and address coverage issues and determine appropriate reserving levels~crlf~##Drafting coverage position letters and reservation of rights letters as needed~crlf~##Select and direct independent external service providers (e.g. lawyers and loss adjusters)~crlf~Settlement~crlf~##Negotiate and resolve high exposure, complex claims ensuring cost effective, service orientated solutions~crlf~##Drive effective subrogation processes~crlf~Referrals and Compliance~crlf~##Ensure all claims handled within authority limits, and in line with AGCS Claims complex procedures and guidelines~crlf~##Refer cases outside of authority level, preparing referral documentation and materials as appropriate~crlf~##Support establishment of claims management procedures on new business accounts in association with clients, brokers and loss adjusters~crlf~Market Management~crlf~##Proactively support underwriting and market management partners in the acquisition of new business and retention of existing business (including client and broker meetings where necessary)~crlf~##Attend industry functions~crlf~Relationship Management~crlf~##Positively represent AGCS externally to the market~crlf~##Develop and maintain strong relationships with key brokers and clients and other relevant stakeholders (e.g. third party adjusters)~crlf~##Effectively report and present complex and contentious loss and claims information internally and externally

  • Key Requirements/ Skills

    ##Bachelor's degree in law, commerce, engineering, or other relevant discipline~crlf~##Completion of LL.B. or JD preferred but not required ~crlf~##Considerable experience (minimum 5-7 years) handling Design Professionals (Architects, Engineers, Construction managers) E&O claims involving complex coverage, liability and damages issues~crlf~##Ideal experience, though not required: Experience handling Miscellaneous E&O, Cyber & D&O claims ~crlf~##Experience attending mediations and leading the charge on strategy and settlement discussions~crlf~##Use general office application tools e.g. Power Point, Excel, Word, Outlook~crlf~##Experience working in complex, global matrix organization ~crlf~##Products and Coverages: Expert understanding in E&O and specifically Design Professionals' insurance products, wordings, terms and conditions and coverages - specifically in relation to complex claims~crlf~##Claims Handling: Expert knowledge of claims handling process from notification to settlement and recovery~crlf~##Expert knowledge of reserving principles and practices~crlf~##Expert knowledge and experience drafting coverage position letters and reservation of rights letters~crlf~##Robust understanding of relevant legal processes and procedures, litigation management, litigation avoidance techniques (e.g. mediation)~crlf~##Ability to analyze highly complex data from multiple sources in detail; identify and resolve issues before they transpire~crlf~##Ability to negotiate with confidence the best position for AGCS, and client, often in contentious situations, managing conflicting priorities of various parties
