ComplexClaims Analyst-D&O, EPL and Fiduciary
This position is responsible for the direct claims handling of the Directors &Officers, Employment Practices and Fiduciary Liability claims. In general this includes: claims and coverage analysis, preparation and communication of appropriate coverage positions, negotiation of coverage allocation issues, case reserve management, claim file documentation, litigation management including approval of defense counsel and external vendors, review and approval and/or adjustment of invoices, interaction with distribution channel partners, developing and execution of claim handling action plans, participation at settlement conferences and resolution of covered claims
## Claim & Coverage Analysis: Conduct a comprehensive analysis of litigated claims and notice of circumstances in comparison to applicable policy(ies) and prepare a comprehensive and sound initial coverage position. Evaluate and update coverage position throughout life of claim via fact gathering through litigation discovery. Evaluate and approve proposed defense counsel, ensure proposed rates/ fee arrangements and defense staffing model are appropriate for each case. address any potential coverage or allocation issues as appropriate with management's participation. Communicate our coverage position to the Insured and broker in a clear, timely and professional manner.~crlf~## Reserve Management: Evaluate the initial factual allegations and coverage applicability and make recommendations to management and/or independently establish case reserves within approved guidelines and autonomy in the claim system and update as warranted by any material changes in the claim. Re-evaluate reserves as facts develop and material events occur in the claim. ~crlf~## Litigation Management: Evaluate proposed defense counsel for experience adequacy, and that proposed rates/ fixed fees are within approved economic guardrails. Work with Insured to negotiate any deviations between proposed rates/fees and our approved guardrails. Establish a litigation budget for each phase of the litigation and clear reporting channel for periodic defense counsel reports and transmission of legal documents. Review invoices to ensure reasonableness with agreed upon litigation budget through life of the claim.~crlf~## Claim Management: Establish and update an action plan for the management of the claim including settlement strategies. Make recommendations to management as appropriate. Provide input on substantive strategic and tactical direction and execute at a well-reasoned plan of action for resolution.~crlf~## Documentation: Ensure all assigned claims are properly registered in the claims system and that all material claim documentation and file notes are in the claim file. Maintain timely, clear and comprehensive activity notes concerning reserving, action plan and resolution strategy, as well as all written communication.~crlf~## Payment Processing: Ensure that all payments are appropriately processed in the claims system in conformance with guidelines to ensure timely and correct payments.~crlf~~crlf~
##Prefer a law degree~crlf~##3-5 years of experience with: Claims adjustment experience handling complex primary and excess D&O and Employment Practices claims. Fiduciary claims experience is a plus. ~crlf~## Associate level work as a practicing attorney either in a coverage or defense capacity handling D&O and .or EPL matters or comparable.~crlf~## Contract / Legal Analysis - The ability to analyze complex litigation complaints and compare to coverage grants and exclusions of the insurance contract.~crlf~## Economic Analysis - The ability to comprehend and explain expert reports for economic damages calculations.~crlf~## Computer Skills - Ability to learn claims computer system and perform all required data input and transaction functions~crlf~## Analytical - The ability to assimilate and process complex legal and economic information to arrive at well-reasoned conclusions.~crlf~## Communication - The ability to clearly express positions through verbal and written forms of communication.~crlf~## Influencing / Negotiation The ability to effectively advance positions to business partners to achieve desired results.~crlf~~crlf~
